Abstract (Summary)
This master dissertation on law´s social relations ? Civil Process at the Pontifícia Universidade Católica de São Paulo Master Graduation, it has the purpose to considerate the principal alterations in the brazilian civil process, under the justice access that actually is focus on what is justice and not in a general way view, and is prohibited to provocate the jurisdiction without having constitucional efectivity. This work will focus the vinculum juris os the satre decisis e the procedure ways to control it; the reasonable duration oh the demand and the ways to guarantee a fats tramitation; the admissibility court at the extarordinay motion ? general repercussion; L. 9.756/1998 (CPC?), the power´s ampliation off the superior judge, the new position focus on the urgency , such as the Preliminary Injuction and the Writ of Prevention; the regulamention of beeing abusive in the procedure and how to control it, in order to obtain a fairy demand; the punishment measures (CPC?); the statute of limitation at L. 11.280/2006/ the access to justice in execution; .The new system of Defense made by the executed debtor and the legal interpretation between L. 11.232/2005 e 11.382/2006; the objections and and exceptions; the attachment no need as requirement to the objections;the fees in stage of the final sentence; outer space law in the new execution; the preliminary order at the repeated actions - (CPC, artigo 285-A); the binidin judicial precedent (CPC, Artigo 588, parágrafo 1º); the appeal by judge´s own motion; This theme is justified because it is an actual subject inside the new formulation from Brazilian civil procedure , compromised with the legal system as all, specially in constitucional and procedure plans
