Evolução do controle de constitucionalidade das leis no direito brasileiro: rumo ao controle concentrado?
This thesis concerns the evolution of the constitutional control overBrazilian legislation.The work begins with a brief historical analysis of the constitutionalphenomenon, comprising the beginning of constitutionalism, Constitutions andconstitutional control (American, French and Austrian systems).A brief study over the constitutional control?s classification follows.Further on, the thesis focus mainly on the constitutional control?s evolutionaccording to the Brazilian Law, both from the constitutional and ordinary law perspectives,(this latter perspective comprising the period as from Brazilian 1988 Constitution, only).All Brazilian Constitutions (1824, 1891, 1934, 1937, 1946, 1967-1969 and1988) and its most important amendments regarding constitutional control are analyzed.On the other hand, the following ordinary law acts are examined: L.8.078/90 (complex litigation, mainly class actions); L. 9.756/98 (Civil Procedure Code,articles 557 and 480); L. 9.868/99 (ADin e ADC); L. 9.882/99 (ADPF); Civil ProcedureCode, article 475-L, § 1° (unconstitutional res judicata); Civil Procedure Code, article 518,§ 1º (appeal?s judgment); L. 11.417/06 (repercussão geral ? writ of certiorari) and L.11.418/06 (súmula vinculante ? binding precedent).The thesis demonstrates how constitutional control in Brazil evolved froman American judicial review model (diffuse) to one which is much closer to the Europeantradition (concentrated).Nevertheless, considering Brazilian constitutional control?s present stage, itis not possible to predict that the American-diffuse model will be completely abandoned.Analyzing all statute?s changes, it is possible perceive a trend to a hybrid system, thoughwith a raising supremacy of the European-concentrated constitutional control system.This phenomenon can be observed not only trough the implementation ofnew tools that can develop the concentrated control, but also by paralleling diffuse controleffects with the ones of the concentrated control (this is reached by granting binding effectsand erga omnes effectiveness to all constitutional control decisions)
