Identitetsbegreppets utformning i samband med surrogation och återvinning

Identitet har länge varit föremål för diskussion, både inom filosofi och inom juridik. Min avsikt var att försöka utröna om det finns ett samband mellan hur filosofer respektive jurister identitesbegreppet, vad gäller ting. 3 jag har använt en text skriven av en nutida filosof för att försöka utröna hur filosoferna ser på identitesbegreppet. För att kunna utröna hur jurister ser på begreppet har jag studerat ett antal rättsfall. jag har inte kunnat hitta några direkt synbara kopplingar mellan hur begreppet " identitet " används inom filosofin respektive inom juridiken. De har helt enkelt för olika utgångspunkter och för olika värden att tillvarata. Filosofin måste tillvarata den rent logiska tankegången emedan juristen i första hand har tingens värde och även, när det gäller sakrätt, borgenärsintressen att beakta. I have used a text written by a centemporary philosopher to determin philosophers' view on identity. To find 5 out the judicial view on identity I have used a number of different cases. I have not been able to find any visible connections between the use of the conception of identity from the philosophers' nor from the judicial point of view. They have too different values to consider. The philosopher considers the pure logical connection. The judicial view consider the value of the thing.
